High Court Orders AG to Take Over OSP Prosecutions

Accra, Ghana — The High Court in Accra has directed the Office of the Attorney General (AG) to assume control of all criminal prosecutions currently being handled by the Office of the Special Prosecutor (OSP), declaring those prosecutions void.

The ruling establishes that while the OSP has investigative authority, it does not possess independent prosecutorial powers unless authorised by the Attorney General, in accordance with Article 88(4) of Ghana’s 1992 Constitution.

Presiding judge, Justice John Eugene Nyadu Nyante, issued the order following a legal challenge to the prosecutorial mandate of the OSP. The court also awarded costs of GH¢15,000 against the OSP.

The decision stems from the case titled:
GJ/0369/2026 — The Republic vs The Office of the Special Prosecutor (on the Application of Peter Archibold Hyde).

According to reports , the ruling implies that the OSP cannot continue prosecuting cases in court unless it obtains the required authorisation from the Attorney General.

This development is expected to significantly impact ongoing and future prosecutions initiated by the OSP, pending compliance with the court’s directive.
